OPEN TO ELIGIBLE RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF ENTRY, ARE AT LEAST 18 YEARS OLD.

VOID IN PUERTO RICO AND ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

  1. ELIGIBILITY:

The POLITICO Playbook Election Challenge (“Contest”) is open only to residents of the fifty (50) United States and District of Columbia who are eighteen (18) years of age or older at the time of entry. Void in Puerto Rico, all jurisdictions other than those stated above, and where prohibited or restricted by law.  Officers, directors, contractors, representatives, agents, and employees of Sponsor, Insomniac Design, and their corporate parents, subsidiaries, affiliates, advertising and promotion agencies, and any other entity involved in the development or administration of this Contest (Sponsor, collectively with the foregoing, the “Contest Parties”) and members of their immediate families (i.e. spouses, parents, children, siblings, and “steps” of each) and all those persons living in the same household of each, whether or not related, are not eligible to enter or win the Contest. All applicable laws and regulations apply.

 
By participating in the Contest, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of Sponsor and any Contest officials appointed by the Sponsor in all matters relating to the Contest.

 
This Contest is not intended to be used for gambling purposes. If it is determined that a participant is using the Contest for gambling purposes, he/she will be disqualified.

  1. ENTRY PERIOD:

The Contest begins on September 24, 2018 at [6:00:00 am ET] and ends on November 6, 2018 at 6:00:00 am ET (“Entry Period”). Sponsor’s computer clock is the official timekeeping device of the Contest.

  1. HOW TO PLAY:

NO PURCHASE NECESSARY AND NO ENTRY FEE, PAYMENT OR PROOF OF PURCHASE IS NECESSARY TO PARTICIPATE. 

Step 1: Log-in to your POLITICO account at http://www.politico.com/playbookelectionchallenge (or register for a free account if you do not already have one).

Step 2: Select the candidates you believe will win each of the 25 races at the House, Senate, and Gubernatorial level (“Candidate Winners”).  The earlier you complete and submit your selections for all 25 races, the higher the score you will receive for each candidate you correctly predicted would win.  If you submit your selections for all 25 races on the first day of the Entry Period, you will receive 1.50 points for each correctly predicted winning candidate.  Each day of the Contest that passes, you will receive fewer points for each correctly predicted winning candidate in accordance with the chart below.  For example, if you submit your selections for all 25 races on October 1, 2018, you will receive 1.419 points for each correctly predicted winning candidate.  If you submit your selections for all 25 races on the last day of the Entry Period, you will only receive 1.00 point for each correctly predicted winning candidate.

You may change your selections at any time during the Entry Period.  However, your score will be calculated as if you submitted ALL of your predictions on the date you submit your last  updated selection.

The Candidate Winners of each race will be determined as reported by the Associated Press after all votes are counted and results are certified.

Step 3: Answer all three tie-breaker questions that will be presented to you after you complete your initial selections in Step 2 above.  You must re-submit answers to tie-breaker questions if/when you submit alternate answers.  In the event of a tie based on the scores from Step 2 above, the entrant who most closely guessed the correct answers to the most questions will be the potential winner.  In the event there is still a tie after consideration of the answers to the tie-breaker questions, the potential winner will be determined based on a random drawing of the tied entrants.

Compliance with the entry requirements will be determined by Sponsor in its sole discretion.  Submissions that violate, as determined by the Sponsor, in its sole discretion, these entry requirements will be disqualified from the Contest.

Steps 1 through 3 above constitute one (1) entry into the Contest. Each individual is limited to a maximum of one (1) entry into this Contest.  You may not use multiple or fake email addresses; multiple accounts; accounts with fictitious identities; or any autoclicker program, system, macro, script, bot or other device or artifice to participate in the Contest.  If you use any of the foregoing or Sponsor suspects you have used any of the foregoing, you will be disqualified from the Contest.

 
Entrant must be the authorized account holder of the e-mail address registered to the POLITICO account used to enter the Contest.  The “authorized account holder” is defined as the natural person to whom the e-mail address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  In the event of a discrepancy between the identity of the authorized account holder, the “winner,” and the entrant, Sponsor reserves the right, in its sole discretion, to disqualify the disputed entry and select an alternate potential winner based on the entrant whose entry during the applicable Entry Period earned the next highest score.

 
  1. DETERMINATION AND NOTIFICATION OF WINNERS:

Within [seven (7) days] after the Associated Press has reported a final determination of all Candidate Winners as determined in the sole discretion of Sponsor, Sponsor will notify the three (3) potential winners who have earned the highest scores in the Contest by e-mail.  Any litigation, appeals, or requests for vote recounts by Candidate Winners will not be taken into account for the purposes of this Contest.

 
Each potential winner’s right to receive the prize is subject to verification of eligibility, including verification of age and residency. As a condition of receiving the prize, each potential winner must also (i) provide Sponsor with a valid postal mailing address to facilitate delivery of the prize and (ii) sign and return any documents requested by Sponsor, including but not limited to, a W-9 and an affidavit and publicity release.

 

If a potential winner (i) is determined to be ineligible or otherwise disqualified by Sponsor, (ii) fails to respond to Sponsor’s first winner notification message within seven (7) days of notification or after two (2) attempts (whichever occurs first),  (iii) fails to provide his or her postal address to Sponsor for prize delivery purposes, or (iv) fails to sign and return any documents requested by Sponsor, the potential winner will be disqualified and forfeit all interest in the prize, the next highest scoring eligible entrant will be declared a potential winner.  When all final winners are determined, the prizes will be awarded to the final winners in accordance with their scores.

  1. PRIZES:

A total of three (3) prizes will be awarded:

  • First Place Prize: One (1) winner with the highest score will be awarded (i) a brand new 256gb iPhone XS, with an approximate retail value (“ARV”) of $1,149 and (ii) an 8 x 10 original drawing by Matt Wuerker, with an ARV of $500. The color of the phone will be selected in the sole discretion of the Sponsor.

  • Second Place Prize: One (1) winner with the second highest score will be awarded (i) a 40mm Series 4 Apple watch with aluminum case and sport band, with an ARV of $399 and (ii) an 8 x 10 original drawing by Matt Wuerker, with an ARV of $500. The colors of the watch case and band will be selected in the sole discretion of the Sponsor.

  • Third Place Prize: One (1) winner with the third highest score will be awarded one set of Apple airpods, with an ARV of $159.

 
The total ARV of all prizes is $2,487. Limit one (1) prize per person.

The prizes carry no warranty other than that offered by the manufacturer. Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prizes, including but not limited to their quality, mechanical conditions, or fitness for a particular purpose. The winner agrees to look solely to the manufacturer for any such warranty, representation, or guarantee. 

All prizes are non-transferable and no cash redemption or prize substitution is permitted, except at the sole discretion of the Sponsor. If any prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute a prize, in whole or in part, with one of comparable or greater value.

Each winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the prizes.

Sponsor will pay for the cost of mailing the prizes to the winners. The method of shipping and the carrier will be determined in the sole discretion of Sponsor. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of each winner.

This Contest is in no way sponsored, endorsed or administered by, or associated with Apple. You understand that you are providing your information to Sponsor and not to Apple. You agree to release Apple from all claims arising out of, or in connection with, this Contest.  Any questions, comments or complaints regarding this Contest should be directed to Sponsor and not to Apple.

  1. RIGHT TO USE WINNERS’ [NAME, LIKENESS, AND HOMETOWN INFORMATION]:

Except where prohibited by law, by entering the Contest and accepting the prize, each winner grants to Sponsor and its affiliates, successors and assigns, and others that Sponsor may designate from time to time, the unconditional right, license and permission to use such winner’s [name, likeness, and hometown information] worldwide, in any media now known or hereafter devised, in perpetuity, on a royalty-free basis, without further compensation or right of approval, in order to publicize the Contest and for any other promotional, advertising, publicity or trade purpose. 

 
  1. LIMITATIONS OF LIABILITY OF CONTEST PARTIES:

The Contest Parties assume no liability and are not responsible for, and by entering the Contest you hereby waive and release the Contest Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Contest and/or the receipt, use or misuse of any prize, including without limitation, Claims relating to: (i) the malfunction of any computer, telephone, network, satellite, hardware, software or communications line; (ii) unauthorized human intervention; (iii) incorrect, delayed or inaccurate transmission or capture of winner notifications, prize claims or other information or communications relating to the Contest, or the failure to capture or transmit any such information; (iv) damage to any person’s computer or mobile device; or (v) any errors in these Official Rules, winner notifications or other announcements or communications relating to the Contest. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s).  If due to an error or for any other reason, more legitimate prize claims are received than the number of prizes stated in these Official Rules, Sponsor reserves the right to award only three (3) prizes.  In no event will more than the stated number of prizes (i.e., three (3) prizes) be awarded.

 
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT A PARTICIPANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND PURSUE ALL OTHER REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

 
Sponsor may prohibit an entrant from participating in the Contest or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Contest Parties.

 
  1. SPONSOR’S RESERVATION OF RIGHTS.

If the Contest is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, at its sole discretion, to modify, suspend, or cancel the Contest. In the event of cancellation, Sponsor reserves the right to select eligible, non-suspect entrants as the potential winners based on the eligible entries during the applicable Entry Period that earned the next highest score from the judges.   All Contest materials are subject to verification and are void if (a) not obtained through legitimate channels in accordance with these Official Rules, (b) any part is counterfeited, altered, illegible, reproduced, tampered with or otherwise irregular, (c) obtained where prohibited, or (d) they contain printing, typographical, mechanical or other errors.

 
  1. GOVERNING LAW:

THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF VIRGINIA, WITHOUT REGARD TO ITS CONFLICTS OF LAW PRINCIPLES.

 
  1. PRIVACY:

Any personally identifiable information collected during an entrant’s participation in the Contest will be collected and used by Sponsor, Insomniac Design, and their designees (i) for the administration and fulfillment of the Contest, (ii) as described in these Official Rules, and (iii) in accordance with Sponsor’s privacy policy available at https://www.politico.com/privacy-policy.

 
  1. NO WAIVER/SEVERABILITY/RIGHT TO MODIFY OR DISCONTINUE CONTEST:

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.  Sponsor reserves the right to modify or discontinue the Contest at any time.
